Those of us at the Kansas Real Estate Commission are always happy to talk to both the licensees and the public about the license law and/or the BRRETA. But, as an administrative law agency, we can only provide information. Your questions and our answers must be limited to the license law, rules and regulations and brokerage relationships.

We receive numerous phone calls and e-mails requesting legal advice. Inquiries range from, would it be legal to do this or not to do that, to how do I break an agency agreement, to how do I break a contract, to labor law issues, to tax law questions, to questions concerning clauses in contracts, to questions on association forms.

You name it, we’ve been asked.

We are not experts in civil law, and we will not advise you on any aspect of civil law. We provide information only about the license law or the BRRETA.

If you have questions, you should first ask your supervising broker. You might then consider asking your own attorney, or if allowed, your company’s attorney. If you are a member of an association and have a question concerning a form promulgated by them, try calling them.

Although we are happy to talk to you about the license law, BRRETA or the rules and regulations, please remember we cannot:
• Give legal advice
• Resolve commission disputes
• Recommend an attorney
• Recommend an agent or brokerage firm
• Enforce or rescind contractual agreements
• Collect monies
• Recover losses
• Award damages
• Determine civil liabilities
• Adjudicate civil matters
